Not About AI

November 3, 2026

The last weeks of a sixteen-month fight between two competitors in medical AI were not about AI. They were about records, including deleted messages.

OpenEvidence sued Doximity in June 2025. This October, in the middle of discovery, both companies told the court they had settled. Every claim and counterclaim was dismissed with prejudice. The terms are not public, each side pays its own fees, and whether the agreement could have been reached sooner, nobody outside the room can know.

Read from the pleadings, each company wanted the other to stop something. OpenEvidence wanted a competitor to stop getting inside its medical AI to learn how it works. Doximity wanted that competitor to stop attacking it in public. Both are about conduct going forward, between two companies that will keep competing for the same doctors.

Sometimes a case has to run before either side is ready to settle. Claims get tested, theories fall away (here, the trade-secret claim was dropped), and each side learns what its position is worth. Those months buy information. They also come with a bill:

Fees on both sides through a motion to dismiss, an amended complaint, counterclaims and a discovery fight, with each company now absorbing its own.

Leadership time spent on each other instead of on the product they were racing to build.

Disclosure. Each side ended up showing a competitor things it might never have had to show at a negotiating table.

A public record of allegations in both directions, now permanent, with nothing decided.

Sometimes the months are what make an agreement possible. Either way, they set its price.
